Whistleblower

Employees in private or public employment who witness and report acts that violate or potentially violate known environmental, health, or safety laws or regulations are whistleblowers and there are various laws that may provide protection from retaliation.

Government employees are often protected from retaliation by specific whistleblower laws when they witness and report abuse of authority, violations of county state or federal laws, activity that creates a substantial danger to public health or safety, or a gross waste in public funds.

Individuals, whether employees or not at the time, who witness outright fraud against the federal government have protections as well as recourse available under the Federal False Claims Act.

Employees who blow the whistle on any violation of any provision, rule or regulation of the Securities and Exchange Commission, or any provision of Federal law relating to fraud against shareholder, are protected by the whistleblower protection provisions of the Sarbanes-Oxley Act of 2002.

THERE IS NOT ONE WHISTLEBLOWER LAW PROTECTING AGAINST RETALIATION. Instead, there are various laws and regulations that provide protection from retaliation in specific circumstances. Who you are, what you reported/disclosed, and to whom, is relevant in determining whether there are any legal protections from retaliation. The MSPB (Merit Systems Protection Board) is part of what determines those protections.

As a former attorney with the Government Accountability Project and in private practice, I have successfully represented numerous whistleblowers for over sixteen years including employees of the Trans-Alaska Pipeline, of Commercial Nuclear Power Plants, of various federal government departments and agencies, of federal contractors, and of local government. Before you decide to blow the whistle, get professional advice from an MSPB Employee Attorney about employment survival strategies as well as what legal protection you may have.
